1. Introduction

These Terms and Conditions (“Agreement”) govern the relationship between BIKERZZ.IN (“the Company,” “we,” “our,” or “us”) and the Vendor (“you,” “your,” or “partner”) who lists and rents vehicles through our platform (“Platform”).

By registering as a Vendor and listing vehicles, you agree to comply with these terms and all applicable laws.

2. Vendor Eligibility

• Possess all necessary documents for each vehicle.
• Ensure that all listed vehicles are legally registered, insured, and roadworthy.
• Be at least 18 years of age and capable of entering into a binding contract.

3. Vehicle Standards and Maintenance

• Vehicles are well-maintained, clean, and in excellent mechanical condition.
• Vehicles undergo regular servicing and safety checks.
• Any vehicle with known defects or damages must not be rented until fully repaired.
• Helmets and required accessories (as per law) are provided to customers.

4. Documentation and Verification

The Vendor must provide:

• Valid Registration Certificate (RC) & Insurance copy
• Vehicle photos and other details requested by the Company

Failure to submit accurate documents may lead to listing suspension or removal.

5. Booking and Pricing

• Vendors are responsible for setting accurate prices, subject to Company guidelines.
• The Company may offer discounts or promotional offers (with Vendor’s prior consent).
• Bookings through the Platform are binding, and cancellation policies must be clearly defined.
• Vendors must honor confirmed bookings and not change terms after confirmation.

6. Revenue Sharing and Payments

• The Company will deduct a commission of 15% on each booking as mutually agreed.
• Payments to Vendors will be made weekly after successful ride completion.
• The Vendor must provide valid bank details for payouts.
• Any disputes regarding payment must be raised within 7 days of receipt.

7. Customer Service and Conduct

• Treat all customers professionally, respectfully, and fairly.
• Provide timely assistance in case of vehicle breakdowns or issues during rental.
• Not engage in any fraudulent, abusive, or unethical practices.
• Avoid direct solicitation of customers outside the platform for future rentals.

8. Cancellation and Refunds

• Vendors must follow the Platform’s cancellation and refund policy.
• Repeated cancellations or poor service may result in account suspension or termination.

9. Insurance and Liability

• Vendors must ensure all vehicles have valid comprehensive insurance coverage.
• The Vendor is responsible for any loss, theft, damage, or legal claims arising from their vehicles.
• The Company acts solely as an intermediary and is not liable for any loss or damage caused by Vendors or customers.

10. Data and Confidentiality

• Vendor agrees not to misuse any customer data obtained via the Platform.
• All business, operational, and customer data remains confidential and property of the Company.

11. Quality Control and Audits

• The Company reserves the right to conduct periodic inspections of listed vehicles.
• Request service records or maintenance logs.
• Temporarily suspend or delist vehicles not meeting quality standards.

12. Brand and Representation

• Vendors must not misuse the Company’s name, logo, or brand without permission.
• Vendors may display “Listed on BIKERZZ.IN” branding only as per approved guidelines.

13. Termination

The Company may suspend or terminate Vendor accounts if:

• Terms of this Agreement are violated.
• Customer complaints or quality issues are frequent.
• Legal or safety violations occur.

Either party may terminate the relationship with 7 days’ written notice.

14. Indemnification

The Vendor agrees to indemnify and hold harmless the Company, its affiliates, and employees from any claims, damages, or losses arising from:

• Breach of this Agreement,
• Violation of law, or
• Any negligence or misconduct by the Vendor.

15. Amendments

The Company reserves the right to amend these Terms and Conditions with prior notice. Continued use of the Platform after changes constitutes acceptance of the updated terms.

16. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of India.

17. Acceptance

By registering as a Vendor and listing vehicles, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
